Upcoming OFA Events
OFA looks forward to continuing the momentum from
Sunriver with several opportunities for members to connect in the
months ahead. Please mark your calendars for the upcoming OFA
Member Holiday Party on December 9 from 2:30–5:30 p.m. at
Waverley Country Club. This annual gathering is a great opportu-
nity to celebrate the season, reconnect with fellow members, and
close out the year together.
Members should also save the date for OFA’s next Annual
Conference, returning to Sunriver, Oregon, July 11–13, 2027.
More details will be shared as planning gets underway, and we
look forward to welcoming members and guests back to Central
Oregon for another strong conference program.

Oregon Policy Update
OFA continues to monitor several important policy and
regulatory developments in Oregon that could affect fuel distribu-
tors, energy markets, local governments, and consumers. This
update summarizes recent activity and highlights areas where
OFA will remain engaged on behalf of members.
Oregon EPR Held Constitutional
U.S. District Judge Michael Simon rejected a constitutional chal-
lenge to Oregon’s extended producer responsibility packaging
program, finding that the law does not violate the dormant Com-
merce Clause or Due Process Clause. While the ruling allows
the program to move forward for now, OFA expects continued
legislative discussion and a likely appeal to the Ninth Circuit. We
will continue tracking potential impacts for members as imple-
mentation and legal proceedings develop.
Revenue Forecast & September Interim Days
Oregon’s latest revenue forecast increased projected General
Fund resources despite continued weakness in the state’s private-
sector job market. The 2025–27 forecast increased by $55 mil-
lion, while the 2027–29 forecast increased by $540 million and
anticipates nearly $7 billion, or 18.6%, in budget growth over the
current biennium. The Legislature will meet September 8–10 for
interim hearings, which should provide an early look at priori-
ties for the 2027 session. OFA will send a fuller update following
those meetings.
Climate Policy
The Governor is exploring an economy-wide cap-and-invest
program that could link Oregon with California and Washington
and potentially replace the Climate Protection Program. OFA has
been invited to participate in a small stakeholder group evaluat-
ing options over the next month and is one of only three regulated
entities represented. Our priority will be ensuring that any new
program, and any transition from the CPP, does not unfairly or
unnecessarily burden OFA members.
CEI Hub Fuel Storage
The City of Portland continues to pursue a 20% reduction in
fuel-storage capacity at the CEI Hub by 2036. Comments are due
September 16. OFA will circulate draft comments for member
review and encourages individual members to submit comments
as well. OFA and WSPA also continue to raise concerns with state
and local officials about the statewide fuel-supply implications of
the proposal, including potential consumer price impacts.
Multnomah County Fuel Tanks
Multnomah County’s Climate Justice Plan calls for expanding
seismic-safety requirements to smaller aboveground fuel-storage
tanks. The state program currently applies to tanks larger than
one million gallons, while the county has identified eight facili-
ties with capacity between 50,000 and one million gallons. It
remains unclear whether the county will pursue its own regula-
tory program or seek changes to state law. OFA will continue
monitoring the issue and evaluating potential implications for
affected facilities.
Transportation
The Governor’s transportation work groups continue developing
priorities and tradeoffs for a potential 2027 transportation pack-
age. OFA continues to oppose proposals that would put additional
pressure on local governments to increase gas taxes, an approach
several local governments have also questioned. We will remain
engaged as transportation revenue discussions continue and will
advocate for policies that avoid unnecessary cost increases for
members and consumers.
